These terms and conditions are effective immediately by accessing or using the site. you are agreeing to these Terms and legally binding contract with EVRIM Digital Services Private Limited. Do not access or use the site if you are unwilling or unable to be bound by the Terms.

We may modify the Terms from time to time. You understand and agree that your access to or use of the Site is governed by the Terms effective at the time of your access to or use of the Site. You should revisit these Terms on a regular basis as revised versions will be binding on you. Any such modification will be effective upon our posting. You understand and agree that your continued access to or use of the Site after the effective date of modifications to the Terms indicates your acceptance of the modifications.
To access or use the Site, you must be 18 years or older and have the requisite power and authority to enter into these Terms. You may not access or use the Site if you are a competitor of ours or if we have previously banned you from the Site or closed your account.

Our Right to Use Your Content

As between you and evrimdigi.cm , you own Your Content. We own the our Content, including but not limited to visual interfaces, interactive features, graphics, design, compilation, including, but not limited to, our compilation of User Content and other Site Content, computer code, products, software, aggregate user review ratings, and all other elements and components of the Site excluding Your Content, User Content and Third Party Content. We also own the copyrights, trademarks, service marks, trade names, and other intellectual and proprietary rights
Evrimdigi and its partner / Associate may publicly display advertisements and other information adjacent to or included with Your Content. You are not entitled to any compensation for such advertisements. The manner, mode and extent of such advertising are subject to change without specific notice to you.
User Content (including any that may have been created by users employed or contracted by company) does not necessarily reflect the opinion of company. We reserve the right to remove, screen, edit, or reinstate User Content from time to time at our sole discretion for any reason or no reason, and without notice to you.
We are under no obligation to enforce the terms on your behalf against another user. While we encourage you to let us know if you believe another user has violated the terms, we reserve the right to investigate and take appropriate action at our sole discretion.
You agree not to, and will not assist, encourage, or enable others to use the Site to:
Violate our Content Guidelines, for example, by writing a fake or defamatory review, trading reviews with other businesses, or compensating someone or being compensated to write or remove a review;
Violate any third party’s rights, including any breach of confidence, copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right;
Threaten, stalk, harm, or harass others, or promote bigotry or discrimination;
Promote a business or other commercial venture or event, or otherwise use the Site for commercial purposes, except in connection with a Business Account and as expressly permitted by company.
You also agree not to, and will not assist, encourage, or enable others to Violate the Terms.
Modify, adapt, appropriate, reproduce, distribute, translate, create derivative works or adaptations of, publicly display, sell, trade, or in any way exploit the Site or Site Content (other than Your Content), except as expressly authorized by us.
Use any robot, spider, site search/retrieval application, or other automated device, process or means to access, retrieve, scrape, or index any portion of the Site or any Site Content;
We reserve the right to modify, update, or discontinue the Site at our sole discretion, at any time, for any or no reason, and without notice or liability.
The Terms contain the entire agreement between you and us regarding the use of the Site, and supersede any prior agreement between you and us on such subject matter. The parties acknowledge that no reliance is placed on any representation made but not expressly contained in these Terms.
If any provision of the Terms is found to be unenforceable or invalid, then only that provision shall be modified to reflect the parties’ intention or eliminated to the minimum extent necessary so that the Terms shall otherwise remain in full force and effect and enforceable.
AMC/CMC (All Products)
The Under mentioned terms and condition apply to all AMC & CMCs provided by Evrim Digital Services Private Limited.
1.1 Evrim Digital Services Private Limited or Evrim Digital Services or EvrimDigi means ‘Company’ incorporated under the Provisions of Companies Act, 2013, having It’s registered Office at 211, Building No- 6/B, ANIK, Bhakti Park, Wadala(E), Mumbai- 400037, India.
1.2 ‘Customer’ shall mean a Person ( including any entity or association of Persons) who has agreed and subscribe to the Services after completing the required formalities, duly filled Customer Application form ‘CAF’, making necessary Payments, submitting required Documents etc. and becomes the Other Party to the Company.
1.3 ‘Contract’ shall become effective Once Company inspects & approves the asset/equipment and accepts at Its sole discretion.
1.4 ‘Contract Period’ of the AMC/CMC will be Valid for period of 12 Months from the effective date provided by Company and shall continue to remain in force unless terminated earlier as per terms herein.
1.5 ‘Customer Application Form’ or CAF shall mean the non-transferable form appended herewith, which has been filled and executed by the Customer for subscribing to the Services.
1.6 ‘Tariff’ shall mean Charges apart from the Service Tax and other statutory Taxes, Cess under the tariff schedule as notified by Company for providing Services.
Company reserves the right:
2.1 To seek and/or verify the particulars including financial information provided by the Customer, either by It-self or from the independence sources.
2.2 To reject any CAF, in case the particulars provided therein are incomplete, incorrect or for any other legally just the valid reason. The information provided by the Customer or gathered by Company shall become Company’s property even if the CAF is rejected and Company may use the said data for any lawful purpose, subject to the applicable laws and regulations.
2.3 To amend the present Terms & Conditions for the proper provisioning of Services or to comply with the applicable laws & regulations.
3. AMC/CMC TERMS & CONDITIONS
For the period as defined in the contract and subject to terms & conditions, when the appliance is operated and maintained in accordance to the manufacturer’s instructions, Evrim Digital Services agrees to maintain & service the appliance. The company will pay for the repair labour costs and designated spare parts.
3.1 This contract and the terms and conditions herein shall continue to remain in force, if due to any reasons the original manufacturer replaces the asset/equipment of the customer with an asset/equipment of the same model or asset sub-category or of different size/capacity/model/brand but of the same asset sub-category.
3.2 This service contract is offered to customers residing within the Municipal limits of the City or town of the company’s existing service geographies.
3.3 To qualify for the service contract, the asset/s must be in working condition. In case the service contract is to be entered into after the expiry of warranty period or of previous contract, the contract will be accepted subject to checking of the equipment by the company’s representative and verifying that it is in working condition. In case asset is found to be defective and any repair needs to be done, then it will be repaired first and then taken into contract and the repair cost (labour and parts) shall be borne by the Customer.
3.4 The Service Contract covers only functional Parts. Functional Parts are those components that are critical to the performance of the asset’s essential function. Plastic & rubber parts, lamps, interconnecting cable, rubber pads for remote control, interconnecting copper tubes, aesthetic parts and stabilizers are not covered under this service contract. Uninstallation & installation of the asset is not covered under this contract.
3.5 All AMC Payments are to be made in advance and only in Cheque/DD. Cheque/DD to be drawn in favour of “EVRIM Digital Services Private Limited”. In case the cheque issued is dis-honored for any reasons, Company will inform the customer accordingly and if payment is not effected within reasonable time the Contract shall stand revoked. In such cases a minimum penalty of Rs. 450/- will be charged and to be borne by the Customer.
3.6 Contact for the appliance will be activated within a period of 7 working days from the date of realization of the payment and is subject to verification of details provided by the Customer with respect to the appliance. The contract shall be void if the details provided by the customer are incorrect.
3.7 Any change in the registered address of the customer, must be notified by the customer in advance. Service will be limited to areas within the defined service geographies.
3.8 In cases where the customer has sold off or transferred the covered asset, the service contract can be transferred for a fee of Rs. 500/-. This will not affect the validity of the service contract for the remainder period.
3.9 Acceptance/Renewal after expiry of contract shall be at the discretion of company. AMC/CMC charges may vary at the time of renewal.
3.10 The customer needs to login and be a registered user at www.evrimdigi.com and can log in a Service Request. Alternately Customer can also log in a Service Request through our helpline No. +91 22 3223 9999 or mail to us on email@example.com mentioning registered Mobile No./ Contract No.
3.11 The company shall be under no obligation to provide Repair / Service because of improper use, unauthorized alteration, modification or substitution of any part or serial number of the machine is altered, defaced or removed, abnormal voltage fluctuation, rat bite, insect infestation or intrusion neglect, acts of god like floods, lightning, earthquakes etc. or causes other than ordinary use. If our services are required as a result of the causes stated above, such services shall be at extra charge.
3.12 All defective components shall be replaced with compatible working parts and defective parts shall be Company’s property.
3.13 All attempts will be made to attend to the service request within 24 working hours from the time of call registration, however it is understood under exceptional circumstances there could be reasonable delays. While every effort shall be made to give preferential attention to emergency breakdown of the equipment, the company shall not be held responsible for any loss arising.
3.14 In case the customer wants to cancel the contract before the completion of the contract period, there shall be no refund of the charges for unexpired period.
3.15 Transportation for taking appliance to the authorized service Centre for repairs shall be borne by the customer as per the applicable rates. Damage to the asset or any parts due to transportation / shifting is not covered under this contract.
3.16 Annual Maintenance Contract (AMC) shall cover free Preventive Services in a Year as per Plan opted along with free labour & Service visits in case of any breakdown. All Other Charges to be borne by Customer.
3.17 Comprehensive Maintenance Contract (CMC) shall cover free Preventative Services in a Year as per Plan opted along with Free Labour & Service Visits in case of any breakdown. CMC shall also cover following parts under the contract-
a- Air Conditioners (AC):
Parts covered: Compressor, Capacitor, Capillary, Drier, Blower Motor, Oscillation Motor, PCB, Relay, Sensor Thermostat.
Parts not covered: Outer Cabinet, Condenser Coil, Cooling Coil, Rubber Components, Plastic Parts, Remote Handset and Front Grill, Gas Charging.
b- Washing Machines (WM):
Semi-Automatic-Parts covered: Wash Motor, Spin Motor, Wash Timer, Spin Timer, Drive Assembly, Bellow Assembly and Capacitor.
Fully automatic- Parts covered: Main Motor, Spin Motor, Wash Motor, Drain Pump, Drain Motor, Pressure Sensor, Capacitor, Inlet Valve, Suspension rod (assembly), PCB.
Parts not covered: Aesthetic Components, Outer Cabinet and Plastic Parts as Cabinets, accessories such as inlet pipe, drain pipe, wash lid, spin lid.
c- Refrigerators (Fridge):
Parts Covered: Compressor, Capillary, Drier, Fan, Motor, Relay, Thermostat, Thermal Fuse and Timer.
Parts not Covered: Cabinet and liner, Coloured Components, Plastic Parts, Door Gasket Assembly, Light bulb, light Switch, Gas Charging.
d- Microwave Owen (MWO):
Parts covered: Blower Motor, Door Switch, High Voltage Transformer, Fuse, PCB, Magnetron, Capacitor, Thermostat, Timer.
Parts not covered: Fuse Socket, Glass Tray, Lamp, Micro Switch and Fan Blade. Aesthetic or Plastic parts such as Cabinets, Cavity, Turn table, Grill Racks.
3.18 Main liner crack, Doors, Bulbs, Rubber Pads, Remote, Stabilizers, consumables, and any damage to the aesthetic components shall not be covered under this contract.
3.19 This contract does not include any kind of software support or installations. Company shall not be responsible for damage to, or loss of, any programs, data or removable storage media including any consequential loss or damage.
3.20 Below situations and evens are not covered in Contract are-
- Cleaning & lubrication, alignment & de-scaling
- Damages caused due to unauthorized repairs, improper usage and defects due to electrical wiring, plug, switches, extension box, inverter, grounding defects and damages due to accidents, sudden surge voltage, fluctuating voltage, loose contacts etc.
- Damages due to negligence, dust, water seepage, corrosion, battery leakage or due to natural calamities like lightning, flood, earthquake, other acts of God etc.
- Installation, removal, dismantling, moving, transfer.
- Defects due to transmission/cable/DTH or any other external source from where the signal/input are fed to the product.
- Product that has been modified, altered, adjusted or repaired/serviced/moved/removed/installed by unauthorized person/s
- Product which is assembled, refurbish and not of a classified manufacturer; discretion of coverage lies solely with Company.
- Defects not covered under manufacturer’s warranty
- Remote control
- Product that has been transferred by customer to any other person.
3.21 Company will repair / replace any defective parts and correct any problems resulting from own workmanship free of charge. Company reserves the right to use reconditioned parts with performance parameters equal to those of new parts in connection with any services performed under Contract. Defective parts becomes Company’s Property.
3.22 Prior to ordering, please, make sure you have carefully read and understood the asset’s/offering’s terms and conditions. If you are not sure about the asset/offerings compatibility, or have questions about asset/offering features, please contact us. All inquiries are free of charge. All service contracts issued to you will be discontinued on a pro-rata basis, final decision on which will be at the discretion of Company. No refunds are issued for provided services (including asset installation, customization and spares replacement).
3.23 While preferential attention will be given to the CMC Customers, company shall not be held responsible for any loss of entertainment/ business or any other consequential loss however arising due to non- availability of parts or delays due to reasons beyond its control.
3.24 In case the asset needs to be transported to the Service Centre for compressor replacement/Gas charging/Major repairs, etc. the cost of transportation will be charged extra. An estimate of the transportation cost will be advised to the customer and upon his approval the matter will be progressed. If any asset under CMC is not repairable due to non-availability of spares or any other reasons beyond our control, we will have the discretion to refund the charges collected for the asset/s on pro-rata basis, less applicable Taxes.
3.25 While every attempt will be made to procure & fit the original parts, in case the original part is not available, we will inform the customer & seek verbal permission to fit the similar or equivalent parts to make the asset functional.
3.26 The CMC will be not applicable if the asset is used for commercial purpose or in any other location other than the Service address specified.
3.27 Charges for Customised Service Contract will Charged as per mutual agreement.
3.28 Working Day – All days of the week except Sundays and public holidays. Working hours – 10.00 AM to 7.00 PM. Appointments for home visits will be fixed as per mutual convenience .
3.29 This agreement/any dispute arising herein shall be subject to Arbitration act and/or any statutory act, amendment or modification thereof, from time to time in force. The venue of such arbitration shall be in Mumbai city and only the courts in Mumbai city shall have the jurisdiction in relation to such arbitration.
- ADDITIONAL T&Cs.
4.1 The customer shall indemnify Company from and against and in respect of any or all liabilities, losses, charges and expenses (including legal fees and costs on a full indemnity basis) claims, demands, actions and proceedings which Company may incur or sustain directly or indirectly from or by any reason of or in relation to the use or proposed use of the services by the customer and shall pay such sums on demand of the Company.
4.2 The Company is hereby authorized to use the location based information provided by any of the telecom companies when the Customer uses the mobile phone to make a booking. The location-based information will be used only to facilitate and improve services.
4.3 The Company shall be entitled to disclose to all companies within its group, or any government body as so required by the law or by directive or request from any government body, the particulars of the customer in the possession of Company in any way as Company, in its absolute discretion, deems fit or if it considers it in its interests to do so.
4.4 If the customer has any complaint in respect of the services, the customer has to inform Company of the same in writing within 24hours of using the services of Company.
4.5 All the Calls made to the Company’s helpline numbers may be recorded by the Company for quality and training purposes.
4.6 The Company may send regular SMS updates or Use Contacts for Its Own Marketing purpose to the mobile number registered with it.

- SERVICE CHARGES & PAYMENTS:
5.1 Customer can pay Service Charges in Cash or Cheque for problems/defects/parts/services which are not covered under Contract. Services / Parts provided by Company, Charges payable by customer are inclusive of taxes, duties or levies unless explicitly stated.
5.2 The Service Call fee is the price to examine and diagnose problem(s) with one appliance based on the symptoms the appliance is having, and to provide a written estimate with parts (if needed) and labour to repair / service the issue(s).
5.3 If we attend to your service request, and if reasonable time and effort has been put in to identify/rectify the problem then the Service Charge needs to be paid regardless of the outcome of the repair.
5.4 As a judicious Customer you do understand that once the technician arrives at your location as per the service request logged by you, the service charge will be applicable, even if you decide not to avail the service.
5.5 Service requests are logged in on basis of information provided by you. Please make sure to give us near exact details with respect to the appliance so that we can send the most suited technician to attend to the complaint. We will not be able to judge the condition of your appliance until we see them and sometimes appliances are beyond any economical repair. If we are unable to service or repair the unit due to reasonable circumstances identified or not the service charge still needs to be paid.
5.6 In the event that details provided by you are found to be incorrect by our visiting technician, appropriate Service Charges as applicable need to be paid by Customers.
